The holidays are fast approaching, and the traffic crisis is seemingly worsening. The time spent on daily commute has increased to unprecedented levels. The time that could be productively spent in school, business meetings, completing deliverables, or resting with our families is now eaten up by the long hours being stuck in traffic. It is estimated that P3.5 billion is wasted everyday in business opportunity and productivity losses due to traffic jams in the Philippines.


In December 2018, the Telecommuting Act (also known as Work-From-Home Law) was passed and signed into law, and the Implementing Rules and Regulations (IRR) were released by the Department of Labor and Employment last March, with active participation from AmCham. The new law offers a viable opportunity for both employers and employees to help alleviate the traffic crisis that adversely affects business and productivity.


The Telecommuting Act enables employees from the private sector to perform their duties and complete their deliverables from an "agreed alternative workplace" through a telecommuting program. The employer may offer such arrangement to its employees through collective bargaining or on a voluntary basis.However, the offer must come from the employer; otherwise the arrangement becomes invalid. The law recognizes the employer's discretion to decide if telecommuting is suitable to the nature of work.
